Attorney Shield® is a powerful mobile application tool to help reduce Your chances of experiencing negative outcomes when engaged by law enforcement. Attorney Shield®, Inc. stands behind the effectiveness and value of its on-demand legal support services delivered through the Attorney Shield® mobile application. In keeping with Our commitment to justice, equity, and member protection, We offer this Limited Warranty to reimburse qualifying and eligible members for certain out-of-pocket costs directly resulting from law enforcement encounters when the service was properly used.
THIS ATTORNEY SHIELD® MEMBER PROTECTION LIMITED WARRANTY ("WARRANTY") IS INTENDED TO PROVIDE SUPPLEMENTAL SUPPORT AND IS NOT A FORM OF INSURANCE OR INDEMNIFICATION.
PARTIES: This Attorney Shield® Protection Limited Warranty (“Warranty”) is between You and D&P Holdings, Inc., dba Auto Trac System (“We” or “Us”). The name, phone number, and mailing address of the Warrantor and Administrator of this Warranty are: D&P Holdings, Inc., dba Auto Trac System, Phone: (800) 353-112318, Augusta Pines Drive, Suite 220W, Spring, Texas 77389, Email: claims@attorney-shield.com
To be eligible for reimbursement under this Warranty:
1. The individual must be an active paid Attorney Shield® member at the time of the incident.
2. The Active paid Attorney Shield® member's account was purchased or existing account renewed on or after the Member Protection Warranty program's effective date. *Existing members may become eligible for the Member Protection Warranty before membership renewal by contacting support at support@attorney-shield.com to complete pre-renewal requirements.
3. The Attorney Shield® app must have been activated during the incident, initiating a live connection with an attorney.
4. The law enforcement encounter must be: (a) Police-initiated (e.g., traffic stop, roadside detention, domestic situation, investigation, etc.) and (b) Occur within the United States.
5. The member’s incident must involve a law enforcement encounter where, based on a reasonable and good faith review by an Attorney Shield's law firm partner, it can be determined that one or more officers unnecessarily or unlawfully escalated the situation, resulting in direct out-of-pocket costs to the member.
Subject to the terms and conditions herein, Attorney Shield may reimburse eligible members up to a maximum Program Limit of $1,000 per covered incident per individual membership year or per family membership per year for documented out-of-pocket expenses toinclude:
1. Post-adjudicated traffic tickets/citations and court ordered fines and penalties
2. Towing, impound, and vehicle storage fees
3. Court filing fees and administrative costs
4. Attorney fees
5. Damage to vehicle or place of residence caused by law enforcement (e.g., broken window or door)
6. Emergency medical treatment resulting from use-of-force
The total dollar coverage allowed under this Warranty is the amount equal to the Program Limits above per individual membership per year, or per family membership per year.
THIS WARRANTY IS A LIMITED PRODUCT WARRANTY. IT IS NOT AN INSURANCE POLICY.
This Limited Warranty guarantees that Attorney Shield® mobile application will connect You with an attorney upon Your initiated request for Service and will deliver a digital copy of the recorded video footage upon Your written request. The duration of any implied warranties are limited to the duration of this Warranty. This Limited Warranty applies only when obligations are fulfilled and does not cover pre-existing instances. This Limited Warranty is subject to all terms and conditions as set forth in this document. Some states do not allow limitations on how long an implied warranty lasts, so the above limitations may not apply to You.
The terms and conditions of this Warranty cannot be altered unless in writing by Us. This Warranty specifically excludes Us from liability for incidental or consequential damages caused by use of the products. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exception may not apply to You. No express rights are given under the Warranty except for those specifically described herein. This Warranty gives You specific legal rights and You may also have other rights which vary from state to state.
To submit a reimbursement request, You must:
1. Submit an online written incident summary within 30 days of the event at https://form.jotform.com/attorney_shield/member_protection_claim_form OR click the "SUBMIT WARRANTY CLAIM" at the top of this web page.
2. Provide the specific date and approximate time of the incident.
3. Submit (upload) receipts or documentation of actual costs incurred.
4. Authorize Attorney Shield® to verify the details of the claim to include an administrative review of available video footage.
5. Digitally sign the claim form.
All reimbursements are subject to internal review and are approved at the sole discretion of the Administrator and Attorney Shield, Inc. Reimbursement will be provided, pursuant to the coverage and limits of this Limited Warranty, for covered claims. Any reimbursement payment must be issued directly to the member. We reserve the right to deny claims found to be fraudulent, incomplete, or unsupported.
Administrator means Auto Trac System, 18 Augusta Pines Dr., Suite 220W, Spring, TX 77389, 800-353-1123.
Customer, Member, You or Your means the member of the Attorney Shield® mobile application as set forth on the front registration page.
Unnecessarily or Unlawfully Escalated means any action taken by law enforcement officer(s) that either: (a) constitutes a violation of applicable laws, regulations, or constitutional rights; or (b) while technically lawful, is deemed excessive, avoidable, or disproportionate to the circumstances, as reasonably evaluated based on the totality of the situation.
Warrantor, We, Us, Our means D&P Holdings, Inc., 18 Augusta Pines Dr., Suite 220W, Spring, TX 77389, 800-353-1123.
The following conditions are excluded and not covered under this Limited Warranty:
1. Incidents in which the Attorney Shield® app was not activated.
2. Member chooses not to contest traffic ticket/citation or arrest charge(s).
3. Driving on suspended license or driving with no license
4. Expired vehicle registration or no vehicle registration
5. Arrest warrant or outstanding arrest warrant(s)
6. Any observed or reported violation of Section “7. Use; Restrictions” of the Attorney Shield® Terms of Service (https://attorney-shield.com/policies/terms-of-service) during the incident
7. Restitution payments, bail/bond payments, civil judgements, and any other expense not explicitly listed in the "What this Warranty Covers" section.
By You: You may cancel this Limited Warranty at any time for any reason to discontinue the service; however, no refund will be provided. To cancel this Limited Warranty, You must contact the Administrator in writing at the address shown on the front registration page or via email at cancellations@autotracsystem.com.
By Us: We may cancel this Limited Warranty before the expiration of the agreed Term if You (I) have made a material misrepresentation related to this Limited Warranty. If We cancel this Limited Warranty, then such cancelation will be effective fifteen (15) days after delivery of written notice to You of the cancellation. Such written notice will state the reason for the cancellation. .
This Limited Warranty is not transferable, and benefits only apply to the enrolled Member.
You are not entitled to recover incidental or consequential damages of any kind under this Limited Warranty. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exception may not apply to You.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
